Terms of Service

These Terms of Service ("Terms") govern your use of the website, booking tools, communications, and services offered by Mission Inspections PLLC, doing business as Mission Inspections ("Mission Inspections," "we," "us," or "our"). By using our website, requesting an estimate, booking an inspection, or using our services, you agree to these Terms. A separate written inspection agreement may apply to a specific inspection. If any provision of that inspection agreement conflicts with these Terms, the inspection agreement will control with respect to that inspection. These website Terms supplement, but do not replace or modify, the applicable inspection agreement.
1. Services
Mission Inspections provides residential inspection and related services, including buyer home inspections, pre-listing inspections, phase inspections, 11-month warranty inspections, pool inspections, landscape irrigation inspections, and non-engineering slab elevation reports. Wood-destroying insect (WDI) inspections are offered through a properly licensed independent partner. The exact scope, price, limitations, exclusions, and deliverables for a particular service will be described in the applicable estimate, booking confirmation, service description, or inspection agreement.
Some ancillary services purchased through or coordinated by Mission Inspections may be performed by independent third-party inspectors, specialists, laboratories, contractors, or other providers. These services include WDI inspections performed by a licensed partner and may also include sewer-scope inspections, mold or environmental testing, engineering evaluations, and similar specialized services. The applicable third party may issue its own report, terms, limitations, certifications, or disclosures and is responsible for the work it performs.
An inspection is a limited, visual, non-invasive evaluation of accessible systems and components at the time of the inspection. It is not a warranty, guarantee, code-compliance certification, engineering analysis, environmental assessment, appraisal, or prediction of future conditions unless a separate written agreement expressly states otherwise.
2. Eligibility and Authority
You must be at least 18 years old and have authority to request the service, enter the property, and provide any instructions or authorizations given to Mission Inspections. You are responsible for obtaining necessary permission from the owner, occupant, or other authorized person.
3. Booking and Customer Responsibilities
You agree to:
- Provide accurate contact, property, scheduling, and access information.
- Disclose known hazards, unsafe conditions, animals, secured areas, utilities that are turned off, and other conditions that could affect the inspection.
- Ensure that the property and agreed systems or components are reasonably accessible at the scheduled time.
- Review and sign any required inspection agreement before the inspection.
- Pay all charges when due.
Mission Inspections may decline to inspect an area or component that is unsafe, inaccessible, obstructed, outside the agreed scope, or likely to cause damage.
4. Estimates, Prices, and Payment
Prices may be based on property size, age, location, service type, travel, ancillary services, or other disclosed factors. Additional charges may apply when information provided during booking is inaccurate or when additional services are requested. Payment is due as stated in the estimate, invoice, booking confirmation, or inspection agreement.
Payments may be processed by third-party payment providers. You authorize us and our payment providers to process the payment method you provide for agreed charges, refunds, or adjustments.
5. Scheduling, Access, Cancellation, and Rescheduling
Appointments are subject to availability, property access, weather, safety conditions, and circumstances outside our control. Cancellation, rescheduling, trip, or access fees may apply when disclosed during booking, in the inspection agreement, or in the appointment confirmation. We may reschedule or cancel an appointment when necessary for safety, access, weather, illness, equipment failure, or other reasonable cause.
6. Inspection Reports and Use
The inspection report is prepared for the client identified in the applicable inspection agreement. Unless otherwise agreed in writing, the report is not intended for reliance by third parties. A third party who receives or reviews the report does so at their own risk and does not become our client.
Reports, photographs, and related materials are protected by applicable intellectual-property laws. The client may use the report for the transaction or purpose for which it was ordered. No report may be altered, misrepresented, publicly posted, resold, or used for commercial training without our written permission.
7. Limitations and Exclusions
Conditions may be hidden, intermittent, inaccessible, concealed by finishes or belongings, or changed after the inspection. Mission Inspections is not responsible for conditions that were not visible or reasonably accessible at the time of inspection. Specialized testing or evaluation by a licensed engineer, electrician, plumber, HVAC contractor, roofer, pest-control professional, environmental consultant, or other specialist may be recommended.
Any limitation of liability, dispute procedure, notice requirement, or claim deadline applicable to a specific inspection will be stated in the inspection agreement and is incorporated into these Terms for that inspection.
8. Website Use
You may use our website only for lawful purposes. You may not interfere with the website, attempt unauthorized access, introduce malicious code, scrape or copy content in a manner that burdens the site, impersonate another person, or use the website to commit fraud or violate any law.
9. Intellectual Property
The Mission Inspections name, branding, website content, forms, graphics, photographs, reports, and other materials are owned by or licensed to Mission Inspections and may not be copied, modified, distributed, or used without permission, except for the client's permitted use of a purchased inspection report.
10. Communications and Electronic Consent
You agree that we may communicate with you electronically about estimates, appointments, agreements, payments, reports, and support. Electronic records, signatures, and notices may be used to the extent permitted by law.
11. Text Messaging Terms
When you provide a mobile telephone number and consent to text messaging, Mission Inspections may send service-related messages, including scheduling information, appointment reminders, arrival updates, access questions, payment notices, report notifications, and customer-support communications.
When you separately consent to promotional text messages, we may send occasional discounts, inspection add-on offers, reminders, and advertisements for Mission Inspections services. Promotional consent is not a condition of purchase. Message frequency varies, and message and data rates may apply. Reply STOP to opt out and HELP for assistance. Wireless carriers are not responsible for delayed or undelivered messages.
12. Privacy
Our collection, use, and disclosure of personal information are described in the Mission Inspections Privacy Policy available at missioninspections.com/privacy-policy.
13. Third-Party Contracted Services
When you purchase or request an ancillary service through Mission Inspections that is performed by an independent third party, you authorize us to share the information reasonably necessary to arrange and complete that service. This may include your name, contact information, property address, appointment details, access instructions, transaction information, and other relevant service information. The third-party provider may contact you directly, enter the property as authorized, perform the service, prepare and deliver its report, and maintain records required by law, regulation, insurance, or professional standards.
Unless otherwise stated in writing, independent third-party providers are not employees of Mission Inspections. Mission Inspections may coordinate scheduling and collect payment, but the provider is responsible for the scope, methods, findings, report, and professional services it performs. Any separate terms or limitations issued by that provider also apply to its service.
14. Third-Party Services and Links
Our website and services may rely on third-party providers or contain links to third-party websites. Mission Inspections is not responsible for third-party content, availability, security, or practices. Use of third-party services may be subject to separate terms.
15. Disclaimers
Except as expressly stated in a written inspection agreement, our website and services are provided on an "as available" basis. To the fullest extent permitted by law, Mission Inspections disclaims implied warranties concerning the website, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes rights or obligations that cannot lawfully be excluded.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold Mission Inspections harmless from claims, losses, or expenses arising from your unlawful use of the website, your violation of these Terms, inaccurate information you provide, or your lack of authority to request access to a property, except to the extent caused by Mission Inspections.
17. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Unless a specific inspection agreement provides otherwise, any legal proceeding arising from these Terms will be brought in a court of competent jurisdiction in Bexar County, Texas.
18. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted at missioninspections.com/terms-and-conditions with a revised effective date. Changes apply prospectively unless otherwise required by law.
19. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. These Terms, together with any applicable estimate, booking confirmation, Privacy Policy, and inspection agreement, form the agreement between you and Mission Inspections concerning the applicable subject matter. In the event of a conflict, the applicable written inspection agreement controls with respect to the inspection services covered by that agreement.
